3. Payments

4. Cancellations, Rescheduling, and Delays

7. Liability and Insurance

We will carry out all services with reasonable skill and care. Except where prohibited by law, we do not accept liability for loss or damage that is not reasonably foreseeable, or for losses arising from circumstances outside our control.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted. Where we are legally responsible for damage to property, our liability will generally be limited to the reasonable cost of repair or replacement, taking account of depreciation and the extent of the loss. We do not accept liability for indirect or consequential losses such as loss of profit, business interruption, or inconvenience.

Any claim must be notified as soon as reasonably possible and in any event within a reasonable time after the issue is discovered. 8. Variations, Completion, and Aftercare

Completion means that the work described in the quotation has been carried out to a reasonable professional standard, subject to any agreed exceptions or site limitations. Minor residual debris, staining, or settling of ground may occur in the ordinary course of arboricultural work and does not necessarily mean the job is incomplete. Any concerns should be raised promptly so that they can be reviewed.

Advice about watering, monitoring, or future maintenance may be offered as a courtesy, but it does not form part of the contract unless expressly included. 9. Governing Law and General Terms

If any clause is found to be invalid or unenforceable, that clause will be severed to the minimum extent necessary, and the remaining provisions will continue in full force.

No failure or delay by us in enforcing any right or remedy shall operate as a waiver of that right or remedy. Any waiver must be in writing. These terms constitute the entire agreement between the parties in relation to the services, except where a separate written contract expressly provides otherwise. They replace prior discussions, estimates, or representations to the extent permitted by law.
