These Terms and Conditions set out the basis on which Tree Surgeons Bow provides arboricultural and tree surgery services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to be bound by these terms. They are intended to clarify how services are arranged, how charges are applied, and what responsibilities sit with each party before, during, and after the works.

1. Booking Process

Any estimate or quotation provided before a full inspection is based on the information available at that time.

When you accept a quotation, you are requesting us to reserve time and resources for the works. A booking is only confirmed once we have agreed the job details, the proposed date or date range, and any required deposit or pre-payment. Confirmed appointments may be subject to change if weather, access issues, consent requirements, or health and safety concerns make it necessary to reschedule. It is your responsibility to ensure that the information you provide is accurate and complete. If the scope changes before work starts, we may revise the quotation, the timing, or both.

2. Quotations and Scope of Work

All quotations issued by Tree Surgeons Bow are based on the work described in writing. Unless otherwise stated, prices are valid for a limited period and may be withdrawn or amended if the specification changes, the job is delayed for an extended time, or further information becomes available. A quotation may include labour, equipment, waste removal, travel time, stump disposal, and any agreed extras, but only if these are expressly listed.

Any additional work requested on the day, or any work required because conditions differ materially from those described at booking, may be charged as a variation. This includes hidden decay, unexpected access difficulties, extra waste volume, or the need for specialist equipment. We will normally discuss such changes before proceeding, except where immediate action is required to protect persons or property.

The customer should review the quotation carefully before acceptance. If anything is unclear, it should be raised before work begins. Once accepted, the specification forms part of the contract between the parties. 3. Payments

Payment terms will be stated on the quotation or invoice. Unless agreed otherwise in writing, payment is due upon completion of the work and must be made by the method specified. We may request a deposit for larger jobs, specialist equipment, or bookings where materials, permits, or advance planning are required. Deposits help secure labour, plant, and scheduling, and may be non-refundable where costs have already been incurred.

Invoices that remain unpaid after the due date may attract late payment charges, statutory interest, and reasonable recovery costs where permitted by law. Where a third party, managing agent, landlord, or business client is responsible for the account, the person placing the booking remains liable unless otherwise agreed in writing. Any discounts, package pricing, or promotional offers are discretionary and may be withdrawn at any time before formal acceptance.

We may occasionally need to revise prices if government charges, disposal costs, fuel, access requirements, or supplier rates change significantly before the job date. If a revision is necessary, we will explain the reason before the work continues, where practical. Tree surgeons Bow will not increase the agreed price without justification related to the contract, the actual conditions encountered, or a written variation requested by the customer.

Where work is split into stages, each stage may be invoiced separately. If part of the project is completed and the remainder is postponed at your request, payment may still be due for the completed portion and any expenses already committed. No set-off or withholding of payment is permitted unless required by law or expressly agreed in writing.

All prices are normally quoted exclusive of VAT unless stated otherwise. If VAT applies, it will be shown on the quotation or invoice at the appropriate rate. Customers who require purchase order references, formal invoicing details, or specific accounting information should provide this before work begins so that records can be prepared accurately.

4. Cancellations, Rescheduling, and Delays

If you need to cancel or reschedule a booking, please give notice as early as possible. Because tree work often requires machinery, staffing, disposal arrangements, and route planning, late cancellation can cause significant cost. We may charge a cancellation fee where notice is insufficient, particularly if the team has already been allocated, materials ordered, or access arrangements made.

If cancellation occurs after arrival on site, or if work cannot proceed because the site is not ready, access is denied, authority is lacking, or hazards have not been disclosed, a call-out fee or wasted attendance charge may apply. This is especially relevant where the team has travelled, equipment has been unloaded, or traffic management and parking arrangements have already been made. 6. Waste Removal and Regulatory Compliance

All green waste, timber, brash, and related debris generated by the agreed works will be handled in accordance with applicable waste legislation and duty-of-care requirements. Unless the quotation states otherwise, waste produced by the job may be removed from site and either recycled, reused, or disposed of through lawful routes. We will take reasonable steps to separate suitable material for processing where practical.

Where waste is left on site at the customer’s request, responsibility for storage, handling, and final disposal may pass to the customer from the time the material is accepted or designated for retention. You should not burn or dispose of arisings in a way that breaches local environmental or nuisance rules. Any instruction to leave logs, chips, or branches on site must be given clearly before completion, and may affect the price.

We will use only licensed carriers, facilities, and processes where required. If waste contains contaminated material, invasive species, hazardous items, or non-tree debris, we may need to segregate it or refuse to remove it until safe arrangements are made. The customer must disclose anything unusual before the work begins. Tree surgeons Bow reserve the right to stop work if unsafe or unlawful waste handling would otherwise result.

7. Liability and Insurance

We will carry out all services with reasonable skill and care. However, tree work carries inherent risks, and outcomes can be influenced by hidden defects, weather, species condition, previous pruning, underground services, and the natural unpredictability of living trees. Except where prohibited by law, we do not accept liability for loss or damage that is not reasonably foreseeable, or for losses arising from circumstances outside our control.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted. Where we are legally responsible for damage to property, our liability will generally be limited to the reasonable cost of repair or replacement, taking account of depreciation and the extent of the loss. We do not accept liability for indirect or consequential losses such as loss of profit, business interruption, or inconvenience.

Any claim must be notified as soon as reasonably possible and in any event within a reasonable time after the issue is discovered. You must allow us an opportunity to inspect the matter before repairs are carried out, unless emergency action is necessary to prevent further damage or danger. Photographs, records, and relevant documentation may assist in resolving any claim fairly.

8. Variations, Completion, and Aftercare

Tree work often requires professional judgement on the day. If we believe that a variation to the agreed plan is necessary to complete the work safely or properly, we may recommend a change to the method or scope. Where possible, the customer will be consulted before the variation is implemented. If immediate action is needed to prevent harm, we may act first and explain the reason afterwards.

Completion means that the work described in the quotation has been carried out to a reasonable professional standard, subject to any agreed exceptions or site limitations. Minor residual debris, staining, or settling of ground may occur in the ordinary course of arboricultural work and does not necessarily mean the job is incomplete. Any concerns should be raised promptly so that they can be reviewed.

Advice about watering, monitoring, or future maintenance may be offered as a courtesy, but it does not form part of the contract unless expressly included. Any future work will be treated as a separate booking and may be subject to separate terms and pricing.

9. Governing Law and General Terms

These Terms and Conditions, and any dispute or claim arising from them, are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction except where the law requires otherwise. If any clause is found to be invalid or unenforceable, that clause will be severed to the minimum extent necessary, and the remaining provisions will continue in full force.

No failure or delay by us in enforcing any right or remedy shall operate as a waiver of that right or remedy. Any waiver must be in writing. These terms constitute the entire agreement between the parties in relation to the services, except where a separate written contract expressly provides otherwise. They replace prior discussions, estimates, or representations to the extent permitted by law.

Tree Surgeons Bow may update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking unless a later version is agreed in writing. By proceeding with a booking, you acknowledge that you have read, understood, and accepted these terms for the requested tree surgery services.
